This Warranty Policy is incorporated into and governed by our Terms and Conditions. In the event of any conflict, the Terms and Conditions control.

1. Manufacturer Warranties

Most products sold by Ag Motion LLC are covered by the original manufacturer’s warranty, if any.

Manufacturer warranties, where applicable:

Are provided solely by the manufacturer
Are subject to the manufacturer’s terms, conditions, and limitations
May require product registration
May require proof of purchase

Ag Motion LLC is not the manufacturer of most products and does not independently extend manufacturer warranty coverage beyond what is provided by the manufacturer.

2. Limited Company Warranty (If Applicable)

If a product is expressly identified in writing as including a Company warranty, such warranty:

Applies only to the original purchaser
Covers defects in materials or workmanship under normal use
Does not cover improper installation, misuse, neglect, accident, modification, or unauthorized repair

Warranty duration, if applicable, will be specified in the product documentation or sales invoice.

3. “AS IS” Sales; Disclaimer of Implied Warranties

Except as expressly stated in writing:

Products are sold “AS IS” and “WITH ALL FAULTS” to the fullest extent permitted by South Dakota law and federal law.

Ag Motion LLC disclaims all implied warranties, including but not limited to:

Merchantability
Fitness for a particular purpose
Non-infringement

If implied warranties cannot be disclaimed under applicable law, they are limited in duration to the shortest period permitted by law and are limited in amount to the purchase price paid for the product.

4. Warranty Claim Procedure

To initiate a warranty claim, contact:

Include:

Order number
Product description
Serial number (if applicable)
Detailed description of the issue
Photos or video evidence, if available

We may require:

Return of the product for inspection
Manufacturer evaluation
Compliance with manufacturer claim procedures

Shipping costs for warranty evaluation may be the responsibility of the customer unless otherwise required by law.

5. Exclusions from Warranty Coverage

Warranty coverage does not apply to damage resulting from:

Improper installation
Failure to follow manufacturer instructions
Lack of maintenance
Misuse or abuse
Unauthorized modification
Normal wear and tear
Environmental exposure beyond intended use

Ag Motion LLC is not responsible for damages caused by incorrect sizing, incorrect product selection, or improper application.

6. Remedies

If a defect is confirmed under applicable warranty terms, remedies may include:

Repair
Replacement
Manufacturer service
Refund of purchase price

Remedies are provided at the sole discretion of Ag Motion LLC or the applicable manufacturer, consistent with applicable law.

7. Limitation of Liability

To the fullest extent permitted by law, Ag Motion LLC shall not be liable for:

Lost profits
Crop loss
Business interruption
Downtime
Consequential damages
Incidental damages
Special or punitive damages

Total liability shall not exceed the purchase price paid for the specific product giving rise to the claim.

Nothing in this section limits non-waivable consumer rights under applicable federal or state law.

8. Magnuson-Moss Warranty Act Compliance

Where applicable, warranties are provided in compliance with the Magnuson-Moss Warranty Act (15 U.S.C. § 2301 et seq.).

This Policy does not limit rights that cannot be waived under applicable consumer protection laws.

9. One-Year Claim Limitation

Any claim relating to warranty must be brought within the limitation period set forth in our Terms and Conditions, including the one-year limitation period for claims where permitted by law.
